Terms of Service
Effective: 3 December 2025. These Terms govern your use of mzansihealthcare.com (the “Platform”). The Platform is operated by [Legal Entity] (Reg. No [Company Reg No]) trading as MzansiHealthcare. By using the Platform, you agree to these Terms.
1) Using the Service
MzansiHealthcare provides a marketplace that connects customers with independent healthcare providers (e.g., clinics, labs, telehealth practitioners) and pharmacies, and may facilitate courier delivery of lawful health products. Unless expressly stated, providers are the sellers of services and products, and couriers are independent contractors.
2) Eligibility
- You must be 18+ to create an account and to purchase restricted medical products or book clinical services.
- Some services require South African residency and/or valid ID for verification.
- By using the Platform you confirm you have legal capacity and agree to comply with applicable laws and guidance.
3) Accounts
- Provide accurate information and keep your credentials secure. You are responsible for activity under your account.
- We may suspend or terminate accounts for fraud, abuse, or policy breaches.
- Addresses and medical information you provide must be current and truthful.
4) Health & Medical Disclaimer (No Emergencies)
- The Platform is not a hospital, clinic, or pharmacy. It is an online marketplace and booking system.
- Information on the Platform is for general information only and is not a substitute for professional medical advice.
- No doctor–patient relationship is created by browsing the site. Such a relationship may arise only when a licensed practitioner accepts you as a patient through a consultation or booking.
- In an emergency call 112 (mobile) or 10177 (ambulance) immediately.
5) Health Content, Self‑Reporting & Advice
- Self‑assessment tools and content may assist understanding but do not diagnose or prescribe.
- You are responsible for the accuracy of symptoms and history you provide.
- Always consult a qualified professional for diagnosis, treatment or medicine advice.
6) Prescriptions, Pharmacy Items & Age‑Restricted Products
- Dispensing of prescription medicines is performed solely by licensed pharmacies. The Platform may facilitate ordering and delivery.
- Valid prescriptions may be required and subject to verification. Substitutions are at the pharmacist’s professional discretion and law.
- Collection/delivery may require ID verification and signature. Some medicines cannot be couriered depending on regulation and stability.
- No sale of controlled or prohibited substances via the Platform. Misuse may result in account termination and reporting.
7) Appointments & Telehealth
- Bookings are provided by independent, duly licensed practitioners or facilities who set their own scopes, schedules and fees.
- Telehealth services (where available) are provided in accordance with applicable South African professional rules and guidance.
- You must ensure you have a private environment and reliable connectivity for remote consultations.
8) Payments & Pricing
- Prices, fees and taxes are shown prior to checkout. Final pricing is determined by the provider or pharmacy.
- Payment processing is handled by integrated payment providers; we do not store full card numbers.
- Where medical aid/insurer claims are offered, eligibility and benefits remain your responsibility.
9) Delivery & Collection
Delivery times are estimates and depend on courier availability, distance, and product type. You must be available to receive deliveries; redelivery or return fees may apply. Risk transfers on delivery to your address or upon collection.
10) Cancellations & Refunds
- Services: Bookings may have cut‑off times and no‑show fees set by providers. See provider policy at checkout.
- Medicines/health products: For safety, many items are non‑returnable unless defective, incorrect, or not as described.
- Where a refund is due, it is processed to the original method; bank processing times vary.
11) User Conduct & Prohibited Use
- No unlawful, deceptive, abusive or harmful behaviour, including attempting to obtain medicines without valid authority.
- No interference with the Platform, scraping, reverse engineering or misuse of health content.
- Respect providers, couriers and staff; zero tolerance for harassment or discrimination.
12) Privacy & Data Protection
We process personal information in accordance with our Privacy Policy and applicable law (including POPIA). Certain data may be shared with providers and pharmacies to fulfil bookings and prescriptions.
13) Intellectual Property
All Platform content (branding, UI, text, code) is owned by us or our licensors. You receive a limited, revocable, non‑transferable licence to use the Platform for its intended purpose.
14) Third‑Party Services
We may integrate maps, payments, identity verification, telehealth video, or courier partners. Their own terms may apply and you agree to comply with them where relevant.
15) Liability
To the maximum extent permitted by South African law, we exclude indirect or consequential damages. Our aggregate liability in connection with the Platform is limited to the greater of R1,000 or the total amount you paid on the transaction giving rise to the claim. Nothing in these Terms limits statutory consumer rights.
16) Indemnity
You agree to indemnify us against claims, losses and costs arising from your unlawful use of the Platform, breach of these Terms, or misuse of health services or products.
17) Suspension & Termination
We may suspend or terminate access for policy breaches, suspected fraud, or safety concerns. You may close your account at any time via support.
18) Changes to the Service or Terms
We may update the Platform and these Terms from time to time. Material changes will be posted with a new effective date. Continued use after changes constitutes acceptance.
19) Governing Law & Disputes
These Terms are governed by South African law (including the Electronic Communications and Transactions Act). Disputes will be subject to the courts of [Province]. Consumers may have recourse under the Consumer Protection Act.
Annex A — Provider (Clinic/Pharmacy/Lab) Terms
- Compliance: Maintain valid licences and professional registrations; comply with scope‑of‑practice, record‑keeping and dispensing laws.
- Listings: Ensure accuracy of services, pricing, availability and contraindications.
- Clinical responsibility: Providers remain solely responsible for clinical decisions and outcomes within their professional scope.
- Payouts & fees: Platform service fees and payout schedules are communicated in your Provider Agreement.
Annex B — Courier/Delivery Terms
- Independent contractor status; comply with transport, safety and confidentiality requirements.
- Age/ID verification when required; follow handling protocols for sensitive health products.
- No tampering with sealed packages; report issues immediately.
